
SCOTUS and Birthright Citizenship
One of the worst court decisions imaginable:
The US Supreme Court has just handed down some very important decisions. Some, like the ruling on states being allowed to keep men out of women’s sports was a great outcome. Justice Clarence Thomas led the way here, stating that “Men and boys with gender dysphoria are not women or girls, even if they believe that they are. Sex is an immutable ‘biological’ characteristic…it is binary.”
But one utterly disastrous decision had to do with birthright citizenship. The opening words of the decision explain what it is all about:
The question presented is whether the Constitution guarantees citizenship to children born in the United States of parents who are unlawfully or temporarily present in the country. Under the Citizenship Clause of the Fourteenth Amendment, “[a]ll persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” On January 20, 2025, President Trump issued Executive Order No. 14160, titled Protecting the Meaning and Value of American Citizenship. The Order provides that children born in the United States of parents who are unlawfully or temporarily present here are not “subject to the jurisdiction” of the United States—and thus do not qualify for citizenship under the Fourteenth Amendment or the Immigration and Nationality Act (INA), which uses the same language.
One thing often forgotten is that the 14th Amendment was especially about freed slaves – not every person on the planet! So now we can have ‘anchor babies’ determining who can come into America – namely, everyone. Already there is so much commentary on this decision that it is best just to let some of these many voices be heard:

The Supreme Court just ruled that, apparently, immigration IS a suicide pact. It has struck down Trump’s birthright citizenship executive order and chose to distort the single most important phrase in the 14th Amendment: “and subject to the jurisdiction thereof.” When the Republican Congress drafted this amendment after the Civil War to protect freed slaves from the Democrat Party’s terror campaign, they inserted that phrase for a definitive reason. It was meant to cover people who owed FULL ALLEGIANCE to this country. It was never written to create automatic citizenship for children born to people who enter our country illegally, or who come here on tourist visas just to give birth, or are part of a mass surrogate campaign run by the Chinese Communist Party to increase its influence over America. The authors of the 14th Amendment would never recognize what the Court did today. They have taken our constitutional compassion, born of justice and mercy, and twisted it into a weapon against us. The 14th amendment was adopted by more than 2/3rds of the members of Congress and thereafter ratified by 3/4ths of the states. Yet, nowhere can the Court or its proponents point to all those elected representatives at the federal and state level who argued for birthright citizenship for the children of aliens — illegal aliens of all matter! If you take the time to read Roberts’s opinion and compare it to Thomas’s dissent, Thomas completely outclasses Roberts. His is a step-by-step history and constitutional lessen that brilliantly and methodically unravels every aspect of Roberts’s argument. Mark R. Levin
Just finished Alito’s dissent. Another brutal takedown of Roberts and the Majority. And he strikes directly at Roberts’s constant refrain about British Common Law being the basis for our understanding of citizenship. Alito makes clear that involved allegiance to the King, and that even Britain abandoned that. That is, Roberts’s entire basis for his arguments about jurisdiction are bogus. Mark R. Levin

Nobody believes that it’s a good idea, or makes any rational sense, to award citizenship to the babies of illegal immigrants. Nobody believes that the Founders ever intended any of this. The Fourteenth Amendment wasn’t written to be a floor mat to mass illegal migration. The Supreme Court got this one wrong. And Congress shouldn’t hide behind the courts. Well the Supreme Court has made their decision…and apparently 5 of the justices think the authors of the 14th amendment clearly meant anyone could randomly show up illegally, have a baby, and that suddenly meant citizenship. We should now move to significantly cut all immigration, and significantly reduce visas. Look, I wanted to be reasonable. Pretty sure we don’t have this in Australia. Does this mean if an illegal has a child in America, the parents can be sent back, but the child has a right to stay? Is this sanctioning separating parents from the child, or is it a back door way of trying to get illegals to be allowed to stay to look after their american citizen child?
The latter Ken. It is just another way to flood the country with migrants, many of whom have no desire of assimilating or supporting American values. They will be lifelong Democrat supporters, and together with the leftist Dems, radically transform the country beyond recognition.
Australia is not all that different, with Labor bringing in 1.5 million migrants in the past few years, including the ISIS brides. The outcome will be much the same.
